Privacy Information

We are committed to protecting Your Privacy in accordance with the Privacy Principles under the Privacy Act 1993. We recognise the importance of privacy protection, and also recognise that when You choose to provide Us personal information about Yourself that You trust Us to act responsibly and in Your best interests therefore We have the following policies in place to protect Your personal information.

The personal information We collect from You will depend on how You use Our Application. You can be certain that the personal information We receive about You will be treated as strictly confidential. Our policy for dealing with any personal information You may disclose to Us whilst using the Application is explained below.

Personal information We Collect

User Provided Personal information

The Application obtains the personal information You provide when You download, register, access and/or use the Application. Registration with Us is mandatory.

When You register with Us and use the Application, You generally provide:

(a) personal particulars (name, address, primary contact email address, name of employer, user name, password and other registration information);

(b) credit card information for the purchase and use of the Application;

(c) personal information You enter into Our system when using the Application, such as contact information, any correspondence involving the use of the Application (emails, posts, comments or opinions, feedback, etc.);

(d) personal information You provide Us when You contact Us for help; and

(e) other personal information provided through competitions, surveys or other activities.

In general, We use personal information We collect for statistical and development purposes only, or in order to provide or improve the Application, respond the user requests, provide technical and customer support, administer Our services and comply with legal obligations.

Third Party Personal Information

We may receive personal information from You about others through Your use of the Application (e.g. name and address). If You provide Us with personal information about others, You must ensure that You are authorised to disclose that information to Us and that, without Us taking any further steps required by applicable data protection or privacy laws, We may collect, use and disclose such information for the purposes described in this Privacy Policy.

Automatically Collected Information

In addition, the Application may collect certain personal information automatically, including, but not limited to, the type of mobile device You use, Your click path data or log files, technical information on Your browser, device and operating systems (e.g. Your server address, domain name, the time and date of when You access the Application, etc.), information about the way You use the Application (e.g. Your clicks and activity on Our web portal, any referral pages/sites visited and any information You choose to download, etc.).

The Application does not collect precise information about the location of Your mobile device.

Database

The names of persons who register the Application are added to our database as registered users. Each registered user is given a user name and password and can view and update their own details by logging in

Non-Personal Information

By using the Application, You agree that We can access, aggregate and use non-personally identifiable data We have collected from You. This data will in no way identify You or any other individual. We may use this aggregated non-personally identifiable data to:

(a) assist Us to better understand how Our customers are using the Application;

(b) provide Our customers with further information regarding the uses and benefits of the Application;

(c) enhance small business productivity, including by creating useful business insights from that aggregated data

(d) otherwise to improve the Application.

Third Party Access to Personal information

Generally only aggregated, anonymised 'non-personal' data is periodically transmitted to external services to help Us improve the Application and Our products and services. However, We may share Your personal information with third parties to be analysed computationally for the purpose of revealing patterns, trends, and associations.

Additionally, We may disclose User Provided and Automatically Collected Information:

(a) as required by law, such as to comply with a court order, or similar legal process;

(b) when We believe in good faith that disclosure is necessary to protect Our rights, protect Your safety or the safety of others, investigate fraud, or respond to a government request;

(c) with Our trusted services providers who work on Our behalf, do not have an independent use of the personal information We disclose to them, and have agreed to adhere to the rules set forth in this Privacy Policy.

(d) If We are involved in a merger, acquisition, or sale of all or a portion of Our assets, You will be notified via email and/or a prominent notice on our website of any change in ownership or uses of Your personal information, as well as any choices You may have regarding Your personal information.

Data Retention Policy, Managing Your Personal information

We will retain User Provided data for as long as You use the Application and for a reasonable time thereafter. We will retain Automatically Collected personal information for up to twenty-four (24) months and thereafter may store it in aggregate. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Security and Storing Your Personal information

We are concerned about safeguarding the confidentiality of Your personal information and will take all reasonable steps to ensure that Your personal information held by Us is accurate up-to date, complete, applicable, is not misleading and will only be used for the purposes stated in this Privacy Policy.

We will maintain physical, electronic, and procedural safeguards to protect Your personal information and will take all reasonable steps to ensure that Your personal information is not accessed or modified by, or disclosed to, any unauthorised person or entity. For example:

(a) Your personal information is passes through and/or is stored on secure servers using SSL (secure sockets layer) encryption technology. The encryption process ensures that Your personal information cannot be read by or altered by outside influences; and

(b) We limit access to Your personal information to authorised employees and contractors who need to know Your personal information in order to operate, develop or improve the Application.

However, the Internet is not in itself a secure environment and We cannot give absolute assurance that Your personal information will be secure at all times. Transmission of personal information over the Internet is at Your own risk and You should only enter, or instruct the entering of, personal information to the Application within a secure environment.

We will advise You, at the first reasonable opportunity, upon discovering, or being advised of, a security breach where Your personal information is lost, stolen, accessed used, disclosed, copied, modified or disposed of, by any unauthorised persons or in any unauthorised manner.

Storage of Credit Card Details

Your credit card details are not stored by the Application and cannot be accessed by Our staff. Your credit card details are encrypted and securely stored by eWay Ltd to enable Us to automatically bill Your credit card on a recurring basis. You should review eWay Ltd's privacy policy on their website (www.eway.co.nz) to ensure You are happy with it.

Storage of Information

All data, including personal and non-personal information, that is entered into the Application by You, or automatically imported at Your instruction, is transferred to Our servers as a function of transmission across the Internet. By using the Application, You consent to Your personal information being transferred to Our servers as set out in this Privacy Policy. By providing Your personal information to Us, You consent to Us storing Your personal information on servers hosting by other parties. While Your personal information will be stored on these servers, it will remain within Our effective control at all times; the server host's role is limited to provide a hosting and storage service to Us (they do not control, and are not permitted to access or use, Your personal information, except for the limited purpose of storing the information), and We have taken steps to ensure that they do not have access to, and use the necessary level of protection for, Your personal information.

Personal information We Use and Release

We will only release personal information about You as authorised by You, required by law or where required in order for Us to allow You access to, and maintain and/or improve, the Application. Where supplied to any third party, the personal information provided will only be sufficient for the third party to perform their services and may not be used by them for any other purpose.

Personal information shall also be used by Us for the following purposes (and for other purposes as shall be agreed between You and Us, or required by law from time to time):

(c) to carry out marketing or training of products and services by Us, Our agents or distributors;

(d) analysing, verifying and/or checking Your registration (including Your identity or credit, payment and/or status in relation to Your registration to the Application);

(e)processing of any payment instructions, direct debit facilities and/or credit facilities as requested by You;

(f) enabling the daily operation of Your registration or administering the Application;

(g) to collate data for business development purposes, and to improve/customise the Application and any other services provided by Us;

(h) assisting with the resolution of technical support issue or other issues relating to the Application; and/or

(i) complying with laws and regulations in applicable jurisdictions.

Personal information held by Us shall be accessed by Us, Our employees and/or any sub-contractors under the following restrictions:

(a) the personal information shall only be used for the purpose of performing the duties set by Us;

(b) any required contact shall be made via email, at no cost or inconvenience, to You;

(c) where (b) applies, the employee or sub-contractor will identify themselves as Our representative.

Personal information held by Us may be released and/or exchanged to individual or entities other than You, specifically:

(a) third parties authorised by You (or any other user) to receive personal information; or

(b) other third parties, required by law, including (where under warrant) law enforcement agencies (e.g. in order to comply with any court orders, subpoenas or other legal process or investigation, including tax authorities). Where possible and appropriate, We will notify You if We are required by law to disclose Your personal information.

We will not release Your personal information for any purpose which You could reasonably expect Us not to release the personal information.

Except as detailed above (and/or unless required by law to do so), We undertake not to share, give, sell, rent, or lease any personal information that You may provide to Us to third parties unless We have Your express consent to do so, and Your personal information will only be disclosed to those employees within Our organisation who have a need to know in order to ensure You are provided with information about Our products and services or to request products and/or services through the Application.

Inaccurate Personal Information

Under the Privacy Act legislation You can request to see any personal information We may hold about You, and You also have the right to have any inaccuracies in the same corrected by Us.

You can access the Application at any time and update Your personal information.

We will comply with any such requests to the extent required by the Privacy Act legislation within fourteen (14) days of the receipt of Your request.

Cookies

In providing the Application, We utilise 'cookies'. A cookie is a small text file that is stored on Your mobile phone, handheld device or computer for record-keeping purposes. A cookie does not identify You personally or contain any other information about You, but it does identify Your mobile phone, handheld device or computer.

We, and some of Our affiliates and third-party service providers, may use a combination of 'persistent cookies' (cookies that remain on Your hard drive for an extended period of time) and 'session ID cookies' (cookies that expire when You close Your browser) on the Application to, for example, track overall usage, and track and report on Your use and interaction with ad impressions and ad services.

You can set Your browser to notify You when You receive a cookie so that You will have an opportunity to either accept or reject it in each instance. However, You should note that refusing cookies may have a negative impact on the functionality and usability of the Application.

We do not respond to, or honour 'Do Not Track' requests at this time.

Third-Party Applications

The Application may allow You to transfer data (including Your personal information) electronically to and from third-party applications. We have no control over and take no responsibility for, the privacy practices or content of these applications. You are responsible for check the privacy policy of any such application so that You can be informed of how they will handle personal information.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify You of any changes to Our Privacy Policy by posting the new Privacy Policy at our website. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

Your Consent

By using the Application, You are consenting to Our processing of Your personal information as set forth in this Privacy Policy now and as amended by Us. "Processing,' means using cookies on a computer/hand held device or using or touching personal information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing personal information, all of which activities will take place in New Zealand. If You reside outside New Zealand, Your personal information will be transferred, processed and stored there under New Zealand privacy standards.

You can stop all collection of personal information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of Your mobile device or via the mobile application marketplace or network.
